1. Quick search - without going to a search engine first.

Are you reading a website and you subsequently discover a word or phrase that you want to put into a search engine? Up until now, I would just open a new tab, type in the URL for Google and manually type the word or phrase in. But it seems there is a faster easier way.

Just highlight the word or phrase with your mouse’s left-click button. Then drag the highlighted text into the address bar in the browser. Then press “enter”. Firefox will now perform a “Are you feeling lucky?” Google search for you.

2. Delete visited URL’s

When you drop down the box underneath the address bar, you can see your recent browsing history. But what if you want to remove one URL from that list? Maybe you’ve been looking at a naughty site and you don’t want your girfriend to know? Or maybe you’ve been shopping for your loved one online and you want to keep it a secret?

Just drop down the URL box, highlight the URL you want to zap then press the “delete” button on your keyboard. The URL will then be removed from the list.

3. Navigate to browser tabs using the keyboard

Instead of using the mouse to click on a tab, why not use the keyboard instead? Pressing CTRL + TAB together will bounce you from tab to tab, starting from the one in the far left and working its way along. Or if you want to go to a specifc tab straight away, you can do that too. CTRL + 2 will take you directly to the second tab from the left. CTRL + 5 will take you to the fifth tab from the left.

4. Start downloads instantly

Instead of right-clicking on a download link, choosing “save to target” and pressing enter, just drag the download link to the “downloads icon” in the toolbar. The download will start automatically.

5. Grab files off webpages, even protected webpages

Have you ever wanted a picture, file or video off a webpage but you can’t, because it’s been protected? Just right-click on the page, choose “View Page Info” then the “media” tab. Find the file you’re looking for from the list and click on “save”. (note : this doesn’t work for everything but I have still had a pretty high success rate nonetheless).

Title VII - “Hispanic” qualifies as a national origin protected class

Title 29 –Labor, Chapter XIV – Equal Employment Opportunity Commission (EEOC), Part 1606 – Guidelines on Discrimination because of National Origin, defines national origin discrimination “broadly as including, but not limited to, the denial of equal employment opportunity because of an individual’s, or his or her ancestor’s, place of origin; or because an individual has the physical, cultural or linguistic characteristics of a national origin group”. Title VII of the Civil Rights Act of 1964 expressly prohibits discrimination on the basis of national origin. The purpose of this paper is to allow the reader to understand how their status as a “Hispanic” is part of the “national origin group” protected class under title VII. Although, the EEOC does not expressly define the term “national origin group”, it broadly defines national origin of an individual’s, or his or her ancestor’s, place of origin or their physical, cultural or linguistic characteristics of a national group. The term “Hispanic” would qualify as such a group due to the very characteristics of Hispanics that are described in the EEOC regulations (Salas v. DOC p.13). In Salas v. Wisconsin Department of Corrections (No. 06-2483, 7th Circuit of Appeals) it was shown that Hispanics qualify as a protected national origin class just by claiming that they are Hispanic without identifying the Hispanic nation from which plaintiff hails, thus clearing the way to survive summary judgment.

“Hispanic” is a National Origin Discrimination Under Title VII

Francisco Salas brought a Title VII national origin discrimination claim against his employer for wrongful termination. His allegations were that the Wisconsin Department of Corrections (DOC) retaliated against him based on his status as a Hispanic. The primary issue on the appeal was whether there was sufficient evidence to support a claim of national origin discrimination. The DOC claimed that Salas’ first prong for prima facie “alleging that he is Hispanic is insufficient to support a claim of national origin discrimination… because Salas did not identify the “Hispanic” nation from which he hailed” (Salas v. DOC p. 12). However, the Court of Appeals for the Seventh Circuit showed in Espinoza v. Farah Manufacturing Co. that the United States Supreme Court recognized that national origin “refers to the country where a person was born, or, more broadly, the country from which his or her ancestors came” (p. 2). Therefore, the court showed that a Hispanic American could claim national origin discrimination on the basis his or her status as Hispanic due to the “country from which his or her ancestors came”.

Understanding Espinoza v Farah Manufacturing Company

Clearly understanding the landmark Espinoza v. Farah Manufacturing Co. case, the Supreme Court drew primary support for its holding from the EEOC guideline which provides:

"because discrimination on the basis of citizenship has the effect of discriminating on the basis of national origin, a lawfully immigrated alien who is domiciled or residing in this country may not be discriminated against on the basis of his citizenship . . . .29 CFR 1606.1 (d) (1972)” (Espinoza v Farah p. 3).

The Court held that non-citizens are entitled to Title VII protection.

The Court stated that a citizenship requirement for a job may violate the law if it has the purpose or effect of discriminating on the basis of national origin. Following this decision, the Commission issued revised guidelines in l975, prohibiting imposition of a citizenship requirement as a job criterion where it has the "purpose or effect" of excluding persons of a particular national origin (Supreme Court in the 1970s.).

Congress did not intend the term national origin to embrace citizenship requirements because “since 1914, the Federal Government itself, through the Civil Service Commission regulations, has engaged in what amounts to discrimination against aliens by denying them the right to enter competitive examination for federal employment” (Espinoza v Farah p. 2). The Supreme Court showed that if the employer is using citizenship requirement to discriminate people of various national origin, through physical, cultural or linguistic characteristics of a national group, then in fact there is a title VII case against said employer. In fact part 1606.4 of Title 29 Chapter XIV – The bona fide occupational qualification exception, states, “The exception stated in section 703(e) of title VII, that national origin may be a bona fide occupation qualification, shall be strictly construed”. It was argued that US citizenship as a requirement for employment disadvantages a legal alien due to the difficult process of naturalization. However, the answer to the argument is that it is not the employer who places the burden of naturalization but Congress itself (8 U.S.C. 1423 (1), 1423 (2), 1427 (a), and 1430). The premise necessary to prove national origin discrimination from an imposition of US Citizenship is that there is a different policy for the foreign born than for those born in the United States as in Phillips v. Martin Marietta Corp. (Espinoza v Farah Footnote 6 p. 6).

Trait-Based Approach to National Origin Claims

Stephen Cutler wrote in the Yale Law Journal,

“Under the current approach to national origin discrimination, the employer who intentionally discriminates among applicants on the basis of national origin-linked characteristics is generally held to have violated Title VII. Still, an employer might offer the hiring of one national origin group member to rebut or preclude an inference of discriminatory motive with respect to another. Further, discriminatory intent is often difficult to prove or lacking altogether (Cutler p. 1164 footnote 3.).

His general thesis of his essay was that employers might actually discriminate applicants based on national origin by hiring applicants of the same national origin but who have assimilated. Therefore violating the guidelines set forth by the EEOC by denying employment based on “physical, cultural or linguistic characteristics of a national origin” (2005 CFR Title 29).

Discrimination is the unjust or prejudicial treatment of different categories of people or things, in this case national origin. The enforcement of title VII broadly protects people of the national origin that has been prejudiced. The issue with a trait-based approach is to show that discrimination may still happen by an employer choosing to accept applicants from a certain national “Hispanic” origin but that dress and speak as United States born citizens or in the same manner as the employer. Thus, discrimination based on national origin between people of the same hailed nation. “Courts should therefore employ a definition of national origin discrimination which includes the concept of discrimination on the basis of national origin-linked traits” (Cutler, p. 1166).

The basis of this section is to show that even if the reader has not been given a position, but it went to another employee from the same ancestral origin it may be due to cultural traits that make the latter seem more assimilated to American culture than the former. Therefore, if it can be proven that an employer has only given employment or promoted to higher positions Hispanics with similar assimilated cultural traits it can be argued that discrimination based on national origin has indeed taken place. As Cutler wrote in conclusion,

Courts should respond to the ideal of individual equality articulated in Connecticut v. Teal and firmly rooted in Title VII and out notions of a just society, by adopting the trait-based approach in Title VII national origin cases. Only then might the employment opportunities available to unassimilated group members accord with those available to assimilated group members, and ultimately, with those available to Americans who trace their ancestry to the Mayflower” (p. 1180-1181).

Title 29 –Labor, Chapter XIV – Equal Employment Opportunity Commission (EEOC), parts 1606 – Guidelines on Discrimination because of National Origin, defines national origin discrimination “broadly as including, but not limited to, the denial of equal employment opportunity because of an individual’s, or his or her ancestor’s, place of origin; or because an individual has the physical, cultural or linguistic characteristics of a national origin group”. Title VII of the Civil Rights Act of 1964 expressly prohibits discrimination on the basis of national origin. The purpose of this paper is to allow the reader to understand how being “Hispanic” is part of the “national origin discrimination” protected class under title VII. The EEOC does not define the term “national origin discrimination” but will examine on a case-by-case basis applying title VII principles, such as disparate treatment and adverse impact whether an employee has been singled out because she is Hispanic. However, in Salas v. Wisconsin Department of Corrections (No. 06-2483, 7th Circuit of Appeals) it was shown that Hispanics qualify as a protected national origin class just by claiming that they are Hispanic without identifying the Hispanic nation from which plaintiff hails, thus clearing the way to survive summary judgment.
